Instructions: Based on the filing date of the claim, the litigation date and the alleged diagnosis date, your claim fails to meet the required Statute of Limitations (SOL). You can review the SOL, as well as possible cures for failed SOL, in Section 5.1(a)(2) of the TDP and in the SOL definition. Both of these documents are located in the Trust Documents section of the Trust's website at www.diiasbestostrust.org. In order to cure the deficiency, you must provide the Trust with a date-stamped copy of the Complaint showing that a DII entity was named in the underlying litigation. Simply updating the claim form with litigation information is not sufficient to cure the deficiency. Please note that effective January 1, 2012, a claim with an SOL deficiency that has been pending for more than 9 months will be disallowed by the Trust.
